जिला योजना मद के तहत सरकार की ओर से जारी धनराशि पर हाईकोर्ट ने लगाई रोक
नैनीताल हाईकोर्ट ने जिला योजना मद के तहत सरकार की ओर से जारी 110 करोड़ रूपये की धनराशि के खर्च करने पर रोक लगा दी है। कोर्ट ने सरकार को चुनाव आयोग से राय मशविरा करने के निर्देश दिये हैं। मुख्य न्यायाधीश रमेश रंगनाथन व न्यायमूर्ति आरसी खुल्बे की खंडपीठ में मामले की सुनवाई हुई। उत्तरकाशी के जिला पंचायत सदस्य प्रदीप भट्ट की ओर से जनहित याचिका के माध्यम से चुनौती दी गयी है। याचिकाकर्ता की ओर से बताया गया कि प्रदेश में जिलों में विकास योजनाओं के संचालन के लिये संविधान की धारा 243 जेड के तहत जिला योजना समिति (डीपीसी) का गठन जरूरी है। इसमें तीन चैथाई सदस्य नगर निगम, नगर पालिका व जिला पंचायतों से चुने जाते हैं जबकि एक चैथायी सदस्य सरकार की ओर से नामित किये जाते हैं। प्रदेश में अभी तक डिस्ट्रिक प्लान कमेटी का गठन नहीं हो पाया है। चुनाव आयोग की ओर से पहले चुनावों की तिथि घोषित की गयी लेकिन बाद में ये चुनाव स्थगित कर दिये गये। सरकार की ओर से विगत 12 जून को एक अध्यादेश जारी कर जिला योजना मद में स्वीकृत धनराशि को जिलाधिकारियों को खर्च करने के अधिकार दे दिये गये लेकिन इसके लिये चुनाव आयोग की राय नहीं ली गयी। इसी बीच सरकार ने 16 जून को जिला योजना मद में 110 करोड़ रूपये की धनराशि को मंजूर कर दी। याचिकाकर्ता की ओर से कहा गया कि सरकार का यह कदम असंवैधानिक है। मामले को सुनने के बाद अदालत ने जिला योजना के लिये स्वीकृत धनराशि पर रोक लगा दी है।
