कूड़ा फेंकना एवं थूकना प्रतिषेध अधिनियम 2016 के दायर याचिका पर सरकार हुआ सख्त
नैनीताल हाईकोर्ट ने कूड़ा फेंकना एवं थूकना प्रतिषेध अधिनियम 2016 के अंतर्गत दायर जनहित याचिका पर सुनवाई हुई राज्य सरकार द्वारा आज रिपोर्ट पेश न करने पर कोर्ट ने नाराजगी व्यक्त करते हुए उत्तराखंड सरकार के स्वास्थ्य सचिव एवं शहरी विकास सचिव से 2 दिन में जवाब दाखिल करने को कहा है साथ ही कोर्ट ने कहा रिपोर्ट पेश न करने पर दोनों सचिव पर अवमानना की कार्यवाही की जा सकती है। मामलें की सुनवाई के लिए कोर्ट ने 28 मई की तिथि नियत की है। आपको बता दें कि अधिवक्ता अभिजय नेगी ने जनहित याचिका दायर कर प्रतिषेध अधिनियम 2016 के तहत सार्वजनिक स्थानो पर कूड़ा फैंकने एवं थूकने पर कड़ाई से पालन कर उसको लागू करने के मांग की थी। गौरतलब है कि उत्तराखंड में इस अधिनियम में स्पष्ट प्रावधान हैं कि थूकना और कूड़ा फैलाने के फलस्वरूप 5000 रुपये का जुर्माना और जेल जाने तक का भी प्रावधान किया गया है। जिसमें राज्य के सभी 13 जिलों के शहरी स्थानीय निकायों को शामिल कर उनकी सीधे तौर पर जवाब देही तय की गयी थी लेकिन इन बीते वर्षों में एक भी चालान नही किया न ही इसे कड़ाई से लागू किया गया ।जबकि इस समय कोरोना संकट काल चल रहा है और कोरोना संक्रमण के दौर में जहाँ ऐसी गंभीर बीमारी थूकने से फैलती है, इस पर माननीय उच्च न्यायालय का ध्यान आकर्षित करते हुए, याचिकाकर्ता ने राज्य सरकार को दिशा निर्देश जारी करने की प्रार्थना की जिससे इस अधिनियम के तहत कार्यवाही की जा सके।
